Promotion Overview
By signing up for the 1 Gig internet service under this promotion ("Promotion"), the customer ("Customer") agrees to receive the specified service at the promotional rate of $50 per month, subject to the terms and conditions outlined below. This offer is valid for new residential customers or existing customers upgrading to 1 Gig internet service who sign a 12-month contract with JBN Telephone Company, Inc. or Giant Communications, Inc.
Eligibility
- The Promotion is available to residential customers only.
- The Promotion is valid for new customers or existing customers upgrading to a 1 Gig service plan.
- To qualify for this promotional offer, the Customer must sign a 12-month service agreement (6-month service agreement for existing internet subscribers) ("Contract") with JBN Telephone Company, Inc. / Giant Communications, Inc. starting from the activation date of the service.
Pricing and Billing
- Under this Promotion, the Customer will receive 1 Gig internet service for a monthly fee of $50, excluding applicable taxes, fees, and surcharges.
- Additional services or equipment may incur additional charges, which will be billed separately.
- After the initial 12-month promotional period (6-month promotional period for existing internet subscribers), standard pricing will apply unless JBN Telephone Company, Inc. / Giant Communications, Inc. extends the promotional rate or a new agreement is entered.
- The Customer is responsible for any applicable state or local taxes, fees, and surcharges as required by law.
Contract and Early Termination
- This Promotion requires a 12-month service contract for new subscribers, or a 6-month service contract for existing internet subscribers. The contract period begins on the activation date of the 1 Gig service.
- Early termination of the Contract by the Customer before the completion of the appropriate term will result in an early termination fee (ETF) of $200, unless termination is due to JBN Telephone Company, Inc. / Giant Communications, Inc.'s inability to provide service.
- The Customer may cancel this Contract without penalty within 30 days of the activation date by providing written notice to JBN Telephone Company, Inc. or Giant Communications, Inc.
Service Availability
- The Promotion is only available in areas where JBN Telephone Company, Inc. or Giant Communications, Inc. provides service and may be subject to availability. JBN Telephone Company, Inc. or Giant Communications, Inc. reserves the right to refuse service to any customer based on the availability of the necessary infrastructure.
Equipment
- The Customer may be required to lease or purchase equipment (e.g., router, modem) from JBN Telephone Company, Inc. / Giant Communications, Inc. to utilize the 1 Gig service.
- The equipment remains the property of JBN Telephone Company, Inc. / Giant Communications, Inc. if leased, and must be returned upon cancellation of service. Unreturned equipment may result in additional fees.
Promotional Period and Renewal
- The promotional pricing is valid for the first 12 months of service (or 6 months of service, if the subscriber was on a 6-month service contract). After this period, the Customer will be automatically transitioned to the standard pricing for 1 Gig service unless a new promotional offer or contract is agreed upon.
- JBN Telephone Company, Inc. or Giant Communications, Inc. reserves the right to modify the pricing or terms of service at the end of the promotional period with prior notice to the Customer.
Changes to Terms
- JBN Telephone Company, Inc. or Giant Communications, Inc. reserve the right to amend these Terms & Conditions as required by law or in response to changes in regulatory requirements. Customers will be notified of any material changes in the terms at least 30 days in advance.
Limitation of Liability
JBN Telephone Company, Inc. or Giant Communications, Inc. are not liable for any loss of service or interruptions caused by events beyond its reasonable control, including but not limited to natural disasters, government actions, and network outages. The Customer agrees that any service outages, slow speeds, or technical difficulties shall not entitle the Customer to a refund or compensation unless otherwise required by applicable law.
Dispute Resolution
Any disputes arising from this Agreement or the Customer’s use of the service shall be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association, with the arbitration taking place in Kansas. The Customer waives the right to participate in any class action lawsuit or class-wide arbitration.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the state of Kansas, without regard to its conflict of laws principles.
Acceptance of Terms
By signing up for the Promotion and receiving service under this Agreement, the Customer acknowledges and agrees to be bound by these Terms & Conditions.
